Chapter 7 bankruptcy is the most common and the most successful form of bankruptcy for an individual. In a Chapter 7 bankruptcy, most unsecured debts are eliminated.  These debts include: 

  • Personal loans
  • Medical Bills
  • Credit cards
  • Memberships
  • Utilities
  • Garnishments
  • Gambling debts

Typically, secured debts, such as a mortgage or car payment, are either reaffirmed or surrendered.  If you are current on your mortgage or car payment, we can usually reaffirm that loan and you can keep that property.  If you do not wish to keep the property, we can surrender it and discharge the debt. Here is the typical process (however, each case is unique):
​
  1. Have a free friendly consultation with Attorney Shelton either in person or over the phone.

  2. Get the required paperwork to our office, which typically means:​​
    1. Last two State and Federal tax returns (if filed)​
    2. Last six months of income information (if any)
    3. Last four months of bank statements (if any)
    4. A copy of your ID and Social Security Card (or documentation with your SSN)
    5. Vehicle titles (if any)
    6. Any other documents the Attorney requests
  3. Take the Credit Counseling Class online or over the phone.​
  4. Attend the meeting of creditors (these are held remote, and you will have to answer some simple questions).
  5. Take the Debtor Education Class online or over the phone.
  6. Wait for your discharge.

Although we make this sound simple, we do not recommend trying this alone.  Chapter 7 trustees have the ability to sell property if it is not properly protected.
